The Queensland Government has just advised that the commencement date for the remaining provisions of the Body Corporate and Community Management and Other Legislation Amendment Act 2013 will be 1 August 2013.
These provisions change the requirements for the Disclosure Statement given by a Seller to a Buyer of a community title lot so that there is no longer a requirement for a Seller to provide the Buyer with a Community Management Statement (CMS) on the sale of an existing lot.
There are also other amendments dealing with termination and cancellation rights arising from the disclosure amendments.
This is another measure by the Queensland Government to cut down the red tape for conveyancing Contracts.
A Buyer who requires a copy of the CMS can still obtain the document by doing a search.
